1. Acceptance of Terms

These Terms & Conditions ("Terms") govern your access to and use of the TosTrip platform, including its website and booking services ("Services"). By accessing the Services or completing a booking, you ("Guest") enter into a legally binding agreement with TosTrip ("Company", "we", "us").

If you are booking on behalf of another person or a group, you confirm that you have the authority to bind all participants to these Terms.

We reserve the right to update these Terms at any time. Continued use of the Services after changes constitutes acceptance of the revised Terms.

2. Service Description

TosTrip connects travellers with local Cambodian host families who offer immersive cultural experiences including, but not limited to:

• Half-day, full-day, and overnight home stays with real local families
• Cooking, farming, fishing, weaving, and artisan craft activities
• Guided cultural excursions (e.g. Angkor Wat visits, boat tours, school visits)
• Traditional Khmer meals prepared and shared with the host family

TosTrip acts as an intermediary platform. The cultural experience itself is delivered by the host family. TosTrip is not responsible for the personal conduct of host families beyond the vetting and onboarding process described in Section 6.

3. Booking & Payment

3.1 Booking Confirmation

A booking is confirmed only when you receive a written confirmation from TosTrip via email. Submission of a booking form does not guarantee availability.

3.2 Pricing

All prices are listed in US Dollars (USD) per person unless otherwise stated. Prices include the experience fee payable to the host family and a TosTrip facilitation fee. Optional add-ons (transport, insurance) are itemised separately at checkout.

3.3 Payment

Full payment is required at the time of booking. We accept major credit/debit cards and approved payment methods listed on the checkout page. All transactions are processed securely.

4. Cancellation & Refund Policy

• 48+ hours before experience: Full refund, no questions asked.
• 24–48 hours before experience: 50% refund issued as a TosTrip credit valid for 12 months.
• Less than 24 hours before experience: No refund. The host family has already prepared and reserved your spot.
• No-show: No refund.
• Cancellation by host family or TosTrip: Full refund within 5 business days, or a rebooking option.

Cancellations must be submitted in writing by email to hello@tostrip.com. Verbal cancellations are not accepted.

5. Guest Responsibilities

As a Guest, you agree to:

• Treat host family members, their home, and their property with respect at all times.
• Follow local customs and cultural sensitivities — we will brief you in advance.
• Arrive at the agreed time. Lateness of more than 60 minutes without notice may result in cancellation without refund.
• Disclose any dietary restrictions, allergies, or medical conditions relevant to the experience at the time of booking.
• Not consume alcohol excessively or use illegal substances during the experience.
• Ensure that any minors in your group are supervised by a responsible adult at all times.
• Not conduct commercial filming or photography inside the host family's home without explicit written consent from TosTrip and the host family.

TosTrip reserves the right to remove any Guest from an experience without refund in cases of misconduct, disrespect, or behaviour that endangers the safety of the host family or other guests.

6. Host Family Obligations

All TosTrip host families are vetted, interviewed, and trained before onboarding. They are expected to:

• Provide the experience as described on the TosTrip platform.
• Maintain a clean, safe, and welcoming environment.
• Respect guest privacy and personal space.
• Not collect additional fees or payments from guests beyond what is arranged through TosTrip.
• Promptly notify TosTrip of any scheduling conflicts at least 48 hours in advance.

7. Liability & Indemnification

TosTrip makes every effort to ensure the safety and quality of our experiences. However, to the maximum extent permitted by Cambodian law:

• TosTrip is not liable for any personal injury, illness, loss, or damage arising from participation in an experience.
• TosTrip is not responsible for the independent actions of host families.
• TosTrip is not liable for any disruption caused by weather, national holidays, civil unrest, or force majeure events.
• Our total liability to you shall not exceed the amount you paid for the specific booking in question.

You agree to indemnify and hold harmless TosTrip, its directors, staff, and host families from any claims arising from your breach of these Terms or your negligent conduct during an experience.

8. Insurance

TosTrip offers optional travel insurance at checkout through partner providers Forte Insurance (Cambodia) Plc. and AIA (Cambodia) Life Insurance Plc. These products are offered for your convenience. TosTrip is not an insurance provider and is not responsible for any insurance claims or disputes.

All insurance policies are subject to the terms, conditions, and exclusions of the respective insurer. Guests are encouraged to read the policy documents carefully before purchase. Insurance add-ons are non-refundable once confirmed.

9. Photography & Media

Personal photography and video for private, non-commercial use is generally welcomed during experiences, subject to the host family's comfort. Please always ask before photographing family members, especially children.

By submitting photos or reviews to TosTrip, you grant TosTrip a non-exclusive, royalty-free, worldwide licence to use that content for marketing and promotional purposes, with attribution where possible.

TosTrip may photograph or film experiences for promotional materials. You will be informed in advance and may opt out without penalty.

10. Intellectual Property

All content on the TosTrip website, including text, images, logos, and design, is the intellectual property of TosTrip or its content licensors. You may not reproduce, distribute, or create derivative works without prior written consent.

11. Governing Law

These Terms are governed by the laws of the Kingdom of Cambodia. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Phnom Penh, Cambodia.

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force.
